Art . 8 (1) In case Ina Essentials wishes to bind the amended General Terms and Conditions and users with contracts ( orders ) valid and uninterrupted as of the day of the update of the conditions , the trader will notify the users by e-mail within 7 days of the amendment .

(2) If the user does not agree to changes in general conditions , the last in 1 month after being notified by written notice to Ina Essentials can withdraw from the contract , without giving any reason and without compensation or penalty , or to continue to fulfill it under the general conditions in force before the amendment .

(3) If it fails to do so within the specified period , the updated General Terms and Conditions shall enter into force with respect to the consumer after the expiration of 1 month from the notification .

Entry into force of the contract

(2) By virtue of the contract concluded between the parties, the seller shall be obliged upon fulfillment of the conditions , specified in art . 5, para . 10, to deliver personally or through third parties to the customer or to persons indicated by him the goods or services ordered by the seller within the terms and conditions of these General Terms and Conditions , and the buyer to pay the agreed price and accept the delivered goods or services .

(2) Delivery of the goods shall be certified by the signature of the client or a person of his or representative on the transport document or receipt , provided / and by courier .

(3) The risk of loss or damage of the goods is on the customer as of the moment of delivery of the goods by the courier to the customer or third parties . If the courier is a person chosen by the customer , the risk is on the customer from the moment of delivery of the goods from Ina Essentials to the carrier . In all cases, in case of established transport defect, the client is obliged to inform Ina Essentials within the terms and conditions of Art . 25 of these General Terms and Conditions .

 

VII. PAYMENT

Shipping fee

(2) The maximum term of delivery of goods within the Republic of Bulgaria shall be 7 ( seven ) working days from the date of confirmation by the seller under Art . 14, para . 2 that the order will be fulfilled .

Art . 25 (1) In case of supply of goods , commissioned by Ina Essentials , the client is obliged to carefully examine her personally or through a third person authorized by him , receiving the same .

(2) Upon detection of externally visible defects - any damage , strokes and other damage , established in delivery , customer or third party should sign the protocol damage in the presence of the courier , in which protocol describing identified defects and immediately , no - no later than 72 hours after delivery , notify Ina Essentials of the findings .

(3) When the delivered goods obviously do not correspond to the ones ordered by the Customer and this can be established during a simple inspection of the delivered goods , the customer has the right within 72 hours to ask Ina Essentials to replace the delivered goods with goods corresponding to the order .

(4) The notification may be made in any of the ways listed in Section II of these General Terms and Conditions or through the contact form on the website .

(5) When notified of the preceding paragraphs Ina Essentials will replace damaged / non-compliant merchandise within 3 / three / working days , except in the cases , where there is no available product of the same type , which Ina Essentials will notify the client promptly and will negotiate with the customer the terms of replacement .

 

Acceptance of the shipment

Art . 26 (1) Upon acceptance of the delivery by the customer or a third party without remarks , all and any subsequent claims for external visible defects of the received goods appear unfounded and as such should not be satisfied . In the event , that has been drawn up and signed a protocol for damages in the presence of the courier upon receipt of the goods and / or the customer does not immediately notify within 72 hours of delivery Ina Essentials of that the Site phone / email / address , the customer loses the right of bringing the identified external visible defects in accordance with the sales contract .

(3) In case of refusal to accept the delivery , the consumer shall owe all costs for the made delivery , which include the price of courier services and packaging .

 

Art . 27 Upon delivery of the goods ( excluding the cases of delivery of goods on payment ), customer or third party , receiving delivery to the specified address , is required to sign the accompanying documents . A third party is considered to be any person who has not placed the order , but accepts the goods upon delivery to the delivery address specified by the Customer .

Art . 28 Ina Essentials ensures the proper packaging of the goods and the sending of the accompanying documents . If for some reason the consignment does not contain a required document to the ordered product or component , then please contact us and we will do everything possible , to provide it possible - fast .

 

Non-acceptance of the order and justified refusal

Term of right of withdrawal and right of replacement

Art . 30 The consumer has no right to withdraw from the contract or to request replacement of a product with another , in the following cases :

(6 ) Supply of goods , which after having been delivered and by their nature are mixed with other goods , which can not be separated , as well as goods , which have already been installed by the user , by Ina Essentials or other persons and cannot be separated from other things ;

(8) in the provision of digital content , which is not supplied on a tangible medium , where the performance has begun with the express consent of the user , which is confirmed , he knows , that in this way will lose his right of withdrawal ;

Return of the goods
Art . 33 (1) Upon refusal by ordering goods from Ina Essentials, as well as a request for replacement , the consumer must in 14 days from the notification , it was withdrawing from the contract or wishes replacement product , return the product in its entirety and state , which was good as it forms , together with issued by Ina Essentials invoice and / or receipt , issued by the seller or courier , delivered the goods , at - above stated address . In certain cases, Ina Essentials may refund you without returning the product .

(3) The amount will be refunded as follows , without leading to any additional cost to the consumer , unless the bank or payment institution , which serves it does not require any fees :
• The payments , made by bank transfer , debit or credit card - in bank account , provided by the user or by reimbursement to the account , from which it was settled .
• The payments , made through cash or otherwise - to a bank account , subsequently provided by the user or by COD - user selectable ;

(3) the proportionate amount of it , which was actually granted to the user so far , in which he informed Ina Essentials for the refusal , if the user has stated , it wants the service has to start immediately ; if the customer is a trader or professional this clause applies , without the need for explicit consent for the start of the service and if Ina Essentials him the possibility of failure ;
(4) the cost of returning the goods back to Ina Essentials;

Other cases of refusal ( cancellation )
Art . 38 (1) Each of the parties has the right to refuse to fulfill ( to cancel ) the made order or its obligations under it , for which it should notify the other party in an appropriate way .
(2) If the cancellation of an order is before the confirmation of the possibility for execution in the sense of art . 14, para . 2, Ina Essentials / the user is not responsible and does not owe compensation and penalties to the other party .
(3) Ina Essentials can unilaterally cancel the contract , in case the customer said product or service from the Site , as noted , that the contract is for a third party ( eg a gift ), whose data is indicated for the purpose of supply . Cancellation in this case can be performed , if Ina Essentials are suspected , the consignment is a menacing , reproachfully , mockingly or otherwise , contrary to good morals , purpose .

Art . 39 Cancellation of an order does not entail any liability or subsequent obligation of either party to the other in connection with it and accordingly neither of them has the right to seek compensation from the other for its cancellation in the following cases :
(1) non-acceptance by the bank - issuer of the client of the transaction for online payment ;
(2) the implementation of the money transaction , which does not lead to the receipt of funds on the seller's account for online payments ;
(3) default or cancellation of contract by the seller , before for the same to have a confirmation under Art . 14, para . 2 of these General Terms and Conditions ;

Art . 40. In the cases under art . 39 the order is canceled automatically .

X. WARRANTY . RIGHT OF COMPLAINT

Non-compliance of the goods with the contract . Legal guarantee

Art . 41 (1) Ina Essentials offers all consumer goods on the Site with a legal guarantee for compliance of the goods with the contract in accordance with applicable law . A good conformity with the contract , if the same holds usual for this type of product quality , functionality and purpose .
(2) Any non-compliance of goods with the contract , which was shown to 6 months after delivery of the goods , considered , that existed in delivering it , unless the seller proves , that the discrepancy is due to other reasons , which Ina Essentials does not respond . For inconsistencies , occurring after the 6- month period, the consumer must prove , that the cause of failure is the responsibility of Ina Essentials.

Deadline for filing a complaint
Art . 42 The complaint of a good / service may be filed by the order of art . 44 user in the following terms :
(1) to 24 months from delivery of the goods , but no - no later than two months from the establishment of the non-negotiated , unless the discrepancy is clearly , in which the time limits , referred to in para . 2 of this provision ;
(2) within 72 hours of acceptance of the goods , where the non-conformity is external , visible and obvious and could have been established at a certain inspection during or immediately after delivery ;
(3) to 24 months from the delivery of the service , but no - no later than 14 days from the establishment of the non-negotiated ;
(4)) shall be suspended in time , need to reach an agreement between Ina Essentials and the customer to resolve the dispute .
(5) The warranty period shall start running from the date of receipt of the goods .

Art . 43 There is no non-compliance of the goods with the contract of sale in the following cases :
(1) the deviation / non-compliance is not significant ;
(2) the consumer had special requirements to the product , which did not indicate in writing to Ina Essentials before the order and the product does not comply with these expectations of the consumer ;
(3) the non-conformity is due to the nature of the goods and their normal wear and tear over time ;
(4) the non-conformity is caused by improper operation / installation / storage / use of the product ;
(5) user at the conclusion of the contract ( contract ) knew or could not be unaware of the non - for example at the time of the contract the consumer is informed us , that the product has certain inconsistencies with the usual ( eg product category on the site with discounted products , goods defect , unpacked goods , when site clearly indicated , that the product is reduced due to existing defect or a particular circumstance );
(6) the non-conformity is visible and obvious and concerns the appearance of the goods ( eg scratches , tears on the packaging or part of the contents of the product ) and could be found in a simple inspection of the goods upon receipt ( delivery ) and yet the consumer has not signed a protocol for damages to the courier and or has not notified Ina Essentials within the time limits under Art . 26, para . 1 of these General Terms and Conditions ;
(7) the non-conformity has occurred after the expiry date indicated on the packaging of the goods ;

Complaint
Art . 44 (1) The consumer has the right within the terms , indicated in art . 42, to file a complaint with Ina Essentials for any non-conformity of the goods with the agreed / ordered /, when after delivery , discrepancies of the goods with the sales contract are found , regardless of whether the manufacturer , importer or seller has provided a commercial guarantee for the goods .
(2) The bringing of the goods in compliance with the contract of sale by Ina Essentials is free of charge for the consumer . The client user is not due to costs for shipping of goods or materials and labor , related to repair it , and does not tolerate significant inconvenience . Professional customer due to expenses for shipment of the goods , if you deliver by courier and if Ina Essentials is given a guarantee of conformity of the goods .
(3) When filing a complaint, the consumer shall indicate the subject of the complaint , his preferred way of satisfying the complaint , preferred way of contact ;
(4) The filing of a complaint shall not be an obstacle for filing a claim .

Art . 45 (1) In cases , where the claim was brought outside the subject of Ina Essentials, the user should provide the goods to the seller at : g . Panagyurishte , st . " Raina Knyaginya " № 13.
(2) The delivery , if a courier is used , shall be at the expense of Ina Essentials, in case the claim is accepted by Ina Essentials as justified .
Art . 46 If Ina Essentials has provided a commercial guarantee for the goods , supplementing the legal guarantee under Art . 42 and the term of the commercial guarantee is more - than the deadlines for filing the claim , the claim may be filed until the expiration of the commercial guarantee .
Registration of the claim . Alignment
Art . 47 (1) Ina Essentials in case of a complaint shall enter the same in the Register of Complaints , providing the user with the number and date of the complaint , as well as information which employee has accepted the same .
(2) Within 30 days from the filing of the complaint, Ina Essentials shall decide whether the same is justified or not .
(3) The consumer should be informed immediately Ina Essentials, in the event that a claim is not submitted documents , containing information under par . 1.

Art . 48 In case of justified complaints, Ina Essentials shall bring the goods in compliance with the contract of sale within the term under 47, para . 2. The goods are brought into conformity with the contract free in one of the following methods at the discretion of the Seller according to the nature of the discrepancy :
(1) repair the product ( if possible and appropriate ) - all repairs to products , purchased from the site are carried out in Bulgaria in services authorized by the seller ;
(2) replacement of the goods with a new one of the same type ;

Art . 49 (1) If any of the actions , indicated in art . 48, para . 1 and para . 2 proves impossible or inappropriate for reasons such as inability to repair due to excessive costs for repair , exceeding the value of the goods , due to substantial non-recoverable defect or because of the nature of the goods , unable to return because of missing product availability , Ina Essentials returns paid by the consumer value for the goods and for their delivery .
(2) Return of the price for the goods and their delivery Ina Essentials shall also owe in the following cases :
▪ three times already repaired goods have been repaired and within the term under Art . 42, para . 1, the goods again show non-conformity ;
▪ when he has not ruled on the claim within the term under Art . 47, para . 2 of these General Terms and Conditions ;

Art . 50 (1) If the goods have not been unreasonably repaired or replaced by Ina Essentials within the term under Art . 47, para . 2, the consumer has the right to cancel the contract and to be reimbursed the amount paid or to request a reduction in the price of the goods .
(2) The user can not claim for rescission of the contract , if the non-compliance of goods with the contract is insignificant .
(3) The consumer has the right under para . 1 and when he is not satisfied with the resolution of the complaint by Ina Essentials. The latter is obliged to satisfy the consumer's request , when after he has satisfied three complaints of the consumer by repairing the same goods , within the term under Art . 42, para . 1, there is a further occurrence of non-compliance of the goods with the contract of sale .
(4) The user can not claim a refund or reduction in price of the commodity , when Ina Essentials agreed to carry out exchange of goods with new or repaired goods within one month of submission of the claim by the user .
(5) In any case of a satisfied claim, Ina Essentials shall issue to the consumer a copy of the act for satisfied complaint , from which the action performed on the complaint shall be visible .

Unfounded claim
Art . 51. The claim is unfounded and will not be accepted , if :
(1) is filed after the deadlines under Art . 42;
(2) any of the conditions in Art . 43;
(3) for the manufacture of the product materials of the client have been used , which due to their quality have led to non-conformity of the finished product received from the materials ;
(4) the consumer has not provided the documents under Art . 44, para . 5 and or has not returned the product , respectively has returned it without the accessories and or components attached to it ;
(5) repairs have been performed or an attempt has been made to carry out repairs and rectify non-conformities by a person or service center not authorized by Ina Essentials ; (6) a modification or change of the technical characteristics has been made and this has happened without the knowledge and consent of Ina Essentials and outside a service authorized by it and or in violation of these General Terms and Conditions ; (7) there is damage , caused by the user or a third party , which Ina Essentials is not responsible , as in the cases , in which the defect is caused by other modules and devices , used in conjunction with product warranty ; (8) is impaired physical integrity of the product and warranty or tape , seals and manufactures labels , designed to prevent intrusion ; (9) in the event of chemical , electrical and / or other effects , unrelated to the normal operation of the product , and when the defect is caused by circumstances , which Ina Essentials does not meet - a mains power failure , power surges , lightning , improper grounding , mechanical deformation , natural disasters , failure to comply with those requirements to the power supply , damage , caused by water or moisture ; (10) The complaint concerns the product , which was purchased by Ina Essentials ( as you indicated , that the product is purchased by us , but you have sent us another product ); (11) in case of a complaint and a product returned by the consumer in poor condition , if the type of product indisputably indicates : (i) abuse of rights ; (ii) the consumer's failure to take due care ; iii) misuse and or maintenance on the product , therefore it can be concluded , that the defect is caused by a fault ( scuff , chipping , crushing the product and or its components , traces of use of force against the product , leakage , compression, etc. ) ; iv) неправилна инсталация , монтиране или намеса ; v) отстраняване или модифициране от трети лица на елементи от продукта ; (12) не е налице несъответствие ; Чл . 52 (1) При неоснователна рекламация Ina Essentials информира писмено потребителя за решението си и се освобождава от отговорност да уважи рекламацията и да извърши привеждане на стоката в съответствие с договора . Ако потребителят е недоволен от решението на Ina Essentials той може да предяви претенцията си по съдебен ред . Това той може да направи и без да предявява рекламация пред Ina Essentials или да изчаква становище на търговеца . (2) Поправката / ремонтът на продукти извън гаранционния срок или в рамките на този срок , но при положение , че задължението на Ina Essentials да приведе стоката в съответствие с договора за продажба е отпаднало на каквото и да е основание , подлежи на заплащане от страна на потребителя и се извършва в срок , уговорен между страните

XI. INTELLECTUAL PROPERTY

XIV. RESPONSIBILITY
Art . 66 (1) InaEssentials and the customer liable for any act or omission , which caused one of the parties damages , including lost profits , according to these Terms and Bulgarian legislation.
(2) InaEssentials / client is not responsible for any suffered by the customer damage , occurred as a result of force majeure or such , beyond the control of the country ..

XV. PROCESSING OF PERSONAL DATA

Art . 67 (1) In accordance with the General Regulation on data protection (Regulation (EU) 2016/679) and Bulgarian legislation InaEssentials and - specifically "Ina Global" Ltd. is the administrator of personal data.
